1. Who we are

KubeQuest is a Kubernetes incident-training platform owned and operated by Or Carmeli, a sole proprietor based in Israel ("KubeQuest", "we", "us", "our"). You can reach us at contact@kubequest.online.

2. Acceptance of these Terms

By creating an account, signing in, or paying for a subscription on kubequest.online, you agree to these Terms of Service and our Privacy Policy and Refund Policy. If you do not agree, do not use the service.

3. The service

KubeQuest offers interactive Kubernetes incident-training content: quizzes, simulated production incidents ("War Room"), architecture scenarios, daily challenges, and a global leaderboard. Some features are free; some require a paid subscription (the "Pro" tier).

5. Subscriptions, billing, and Paddle

Payments are processed by Paddle.com Market Limited and its affiliates ("Paddle"), our Merchant of Record. By subscribing you also agree to Paddle's terms at paddle.com/legal/checkout-buyer-terms. Paddle handles billing, currency conversion, applicable taxes (e.g. VAT), invoicing, and refund processing on our behalf. Your billing-statement descriptor will reference Paddle.

We may suspend or terminate accounts that violate these rules without prior notice.

7. Intellectual property

All content provided by KubeQuest (quizzes, incident scenarios, explanations, brand, code) is owned by Or Carmeli or his licensors. We grant you a personal, non-exclusive, non-transferable license to use the content for the duration of your subscription and for your own learning purposes only.

The open-source portions of the codebase listed at github.com/or-carmeli/KubeQuest are licensed under MIT and are governed by that license, not these Terms.

8. Service availability

The service is provided "as is" without uptime guarantees. We do our best to keep the platform online but we may have maintenance windows or outages. We do not promise that the service will be uninterrupted, error-free, or that all content will remain available forever.

9. Limitation of liability

To the maximum extent permitted by applicable law, our aggregate liability arising out of or relating to your use of KubeQuest is limited to the amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

10. Termination

You may stop using the service at any time. You can request deletion of your account by emailing contact@kubequest.online; we will action the deletion within 30 days per our Privacy Policy.

We may suspend or terminate your account at our discretion if you breach these Terms, if continued service exposes us to legal risk, or if required by law. If we terminate without cause and you have a paid subscription, we will refund the unused portion of the current billing period (prorated).

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced via email to your registered address and via a notice on the site at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance.

12. Governing law and disputes

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles. The courts located in Tel Aviv-Jaffa, Israel have exclusive jurisdiction over any dispute arising out of or relating to these Terms, except where this conflicts with mandatory consumer-protection law in your country of residence.
